		<title>Worried About the Fair Debt Collection Practices Act?</title>

If so, do you know whether the Fair Debt Collection Practices Act, 15 U.S.C. 1692 (the Act) (http://www.ftc.gov/os/statutes/fdcpa/fdcpact.htm) regulates what you do? Do you fear that your collection practices might subject you or your company to liability? Relax. The Act generally does not apply to commercial foreclosures or the collection of commercial debts. (See my 11-1-06 article Just What Is Commercial Foreclosure Law? for more background.) Personal, Family or Household Purposes. The Act focuses on obligations arising from consumer transactions. Bass v. Stolper, et al., 111 F.3d 1322 (7th Cir. 1997). Debt, for purposes of the Act, is defined as an obligation to pay money arising out of a transaction that is primarily for personal, family, or household purposes 15 U.S.C. 1692a(5). A nice article in the American Law Reports Federal explains the concept in detail: What Constitutes Debt for Purposes of Fair Debt Collection? 159 A.L.R. FED. 121 (2000). Even individual guarantors of an obligation do not fall within the scope of the Act if the guaranty is part of a commercial transaction. See the Federal Trade Commissions website (http://www.ftc.gov/bcp/conline/pubs/credit/fdc.htm) for more discussion. My practice and blog are dedicated primarily to commercial deals, not consumer loans. If youre in the same boat, then essentially all you need to know about the Act is (1) its out there, (2) a violation of it is a bad thing, but (3) it generally doesnt apply to you. Behave Appropriately. The legal industry has some very creative attorneys, as well as some judges inclined to protect debtors. There are gray areas in the law. Legal principles evolve, as can the interpretation of statutes like the Act. For instance, the ALR article cites a case from Mississippi in which a commercial debt essentially was transformed into a consumer debt covered by the Act when the debt collector made harsh, abusive, foul, obscene, indecent, uncouth, violent, threatening, intimidating, and harassing phone calls to the debtor. So dont be reckless. Be mindful of the spirit of the Act, which Congress designed to eliminate abusive, deceptive, and unfair debt collection practices. As a general proposition, however, you need not sweat the details of the Act if youre confident that youre dealing with a commercial transaction. When in doubt, however, follow the Act. Or, contact your lawyer for advice. Have a friend or relative evaluate your resume to see if it is clear, consistent, and fairly represents your skills and experience. Is your resume in a high impact format? Be sure to do a spell check on your resume. Misspelled works can reflect negatively on you and diminish your prospects. Many companies have a form on their web sites for submitting electronic resumes. Have a version of your resume that you can cut and paste into submittal forms. Create one that doesn't have columns and indents as these do not work well when pasted into a form. Let your family, friends, alumni groups, and industry contacts know you are looking for a job. Send them your resume. Many jobs are unadvertised and these people may know of potential openings. Also many employers would rather hire someone suggested to them by a person they trust. Summit your resume electronically to companies rather than via paper if possible. Check out their web sites to see if they have a resume submittal form. Submit it through the form, if not send them an electronic version in Word or as a text file. Many large companies put electronic resumes into a database which then can be searched by managers looking to hire additional people. Using the database managers can do keyword searches to quickly find candidates. Most managers do not want to take the time to wade through hundreds of paper resumes looking for candidates. Most paper resumes never even get looked at in some of these large companies. A local large airplane manufacturer and a local large software company rely heavily on their resume database for new candidates. Post your resume to resume databases. Generally the posting is free. This is a lot more cost effective then spending hundreds of dollars in printing and postage costs blindly sending out resumes to companies. Recruiters search these databases looking for candidates to fill positions.. A potentially even more effective approach is to use a resume distribution service. For a small price you can blast your resume out to 1000's of recruiters. This can be more effective than waiting for a recruiter to stumble across your resume in a database. It also only costs a fraction of the amount it would for printing and postage to do a mass mailing of your resume. Most of these services give you some control over what industries and geographic regions your resume is sent to. Many jobs are unadvertised as employers don't want to be bombarded by thousands of resumes. Therefore it is important for you to get your resume in the hands of your contacts. Also get your resume into the databases that potential employers can search. Look in the job databases for potential openings. You can search through thousands of potential jobs using field and location selection criteria.. Many local employers post job openings in this database because the state does not charge a fee for the service. If you are in college or have graduated from a local college check out their career services department. Many have web sites with links to recruiters, upcoming recruiter visits, job postings, and much more. Most major and even local newspapers have online editions with help wanted sections. These can be superior to paper editions because you can often do keyword searches allowing you to zero in on potential jobs. This is much more efficient than reading hundreds of job ads in paper editions. Landing that first job can be hard. Many employers look for "experienced" candidates. If you have had internships be sure to emphasize them in your resume. If you have assisted a professor in research or teaching emphasize that in your resume. Many of your smaller companies feel they don't have the time or resources to train you. They need someone that can be productive now! Generally your larger companies have resources and internal training programs to get inexperienced employees up to speed. Your may have a better chance getting on with a larger company. Your first job may not be your "dream" job. Look for one that can give you experience and make you attractive to an employer a few years down the road. Large companies are often a great place to start because they tend to be the most willing to hire and train new graduates. Unfortunately they are often not the best place to have a career. Many large companies are stagnant or grow slowly. Promotions and career growth is often slow and you have to wait for someone ahead of you to retire. If you go to work for a large company do it for a few years to get some practical experience to add to your resume. If your career has not advanced significantly after a few years look for new opportunities. It is often easy to get stuck at a large company because they offer stability, decent salary, and good benefits. Once you have some experience look for a young fast growing company to join. Often you can ride their success upwards to a much higher position and salary compared to staying with an older slow growth company. Look at what happened to the people that joined Microsoft early on. If you have visions of having your own business some day find out who is the best company in your industry. Go to work for them and learn what they have done to be successful. Also look for how you could do things better than they do. Then after a few years take the plunge and start your own company. Failing to understand how to make a marketing piece viral Often people create what they call a viral marketing piece when it is nothing more than a brochure and an advertisement. It is way too self serving. It has no possibility of creating buzz. While there is no guaranteed formula for creating a viral marketing piece, there are many things you can do to increase its effectiveness and its viral nature. 2. Failing to make it interesting enough to pass along Whether or not there are external incentives to encourage the viral spread, if you failed to make the article or e-book interesting enough with high quality content that is useful or entertaining, you couldnt pay them enough to pass it along. If on the other hand it is very useful, high quality or entertaining, it will get passed along with or without any other incentives. 3. Failing to provide incentives to encourage people to pass your message along While there are many successes where the sender was not rewarded for passing on viral information, it works better if you can provide an incentive. Provide an incentive that you dont have to pay up front. Instead provide a success incentive. If the desired outcome is met then you give them money, commissions, discounts, extended memberships, additional MP3 recordings, more articles, more eBooks, etc. Whatever incentive you decide to use, make sure it is easy to sign up for and easy to collect. 4. Failing to provide an incentive for people to respond to your call to action The way to sell with a viral marketing piece is to do so at the very end, in the conclusion, in the summary or in the resource box. It doesnt need to be a hard pitch, just an offer for an ethical bribe that will move them to visit your website, call your 800 number or send an email to get whatever you are offering. Experience has shown that the incentive should be related to your product or service. If you are a law firm, dont offer a chance to win a Corvette or an iPod. Too many unqualified people will sign up and waste your time following up with them. Instead if you are a law firm specializing in Intellectual Property, offer a free e-book on How you can increase the value of your company with patents and trademarks. 5. Failing to effectively promote their viral campaigns Because weve heard of some success stories where no promotion was needed, it is easy to fall into the trap that yours too will be one of those. Im not sure what the statistics are but the vast majority of viral marketing requires promotion to make them successful. 6. Failing to encourage others to pass it along There is a wonderful piece of wisdom you should apply to viral marketing you have not because you ask not. Does your viral marketing ask the reader to pass this along to others? This can be done in the resource box with something very simple like, If you found this useful, please pass it onto others that might be helped by it too. If it is a viral article and you have also it published on your website, have a button or link on the page that says Send to your friends. While it is true the Send to your friends button wont make it viral all by itself you never know which friend that gets it might decide to promote it to their list of 100,000. 7. Failing to send out anything less than a blockbuster success While it would be nice to repeat viral marketing successes like Blair Witch, Hotmail, Purple Cow or ICQ those are rare occurrences. Just because your idea falls a bit short of phenomenal doesnt mean it isnt worth doing. Lets say you shoot for exponential viral results and only obtain a moderate success, it is still a success. The fact you got free visitors to come to your site is great. I love Michael Jordans quote when he attempted to go into baseball after his wildly successful basketball career. I can accept failure, but I cant accept not trying. Even if you think it wont blow away Blair Witchs success, try it anyway. 8. Focusing on a single viral piece rather than a viral process One thing Ive noticed in my business career is that we tend to adopt the John Wayne syndrome, go big or go home. We give it ONE try and if it fails we go home. I dont know of successful business people or successful marketing campaigns that take that approach. Instead of giving it this one shot and then not doing anything after that, create a process for creating, promoting, testing and measuring continual viral marketing efforts. 9. Failing to test and track the results To be successful you need to experiment with different titles for the article or e-book; test different ethical bribes; try different promotional methods; approach different list owners. Find all of the elements that can be tested in your project, test various combinations and measure the results. 10. Not recognizing it is different from word-of-mouth marketing I fell in love with word-of-mouth marketing early in my consulting career. After 10 years of consulting I analyzed every project Id worked on, every client Id worked for and wrote down the source. To my shock, 95% of all of them came from word-of-mouth. The good news was it was cheap (free). The bad news it was unpredictable and couldnt be controlled on-demand like I needed. Viral marketing is like word-of-mouth in that one person passes it on to another but typical word-of-mouth comes from one person asking the other if they know how to solve a problem. It is much more reactive than proactive. Viral marketing is proactive. A person who reads a viral article or e-book immediately thinks of 5, 10, 500 or even 1,000 people that should know about this and they send it via email or put it up on their website or post in on their blog. Failing to encourage others to pass it along There is a wonderful piece of wisdom you should apply to viral marketing you have not because you ask not. Does your viral marketing ask the reader to pass this along to others? This can be done in the resource box with something very simple like, If you found this useful, please pass it onto others that might be helped by it too. If it is a viral article and you have also it published on your website, have a button or link on the page that says Send to your friends. While it is true the Send to your friends button wont make it viral all by itself you never know which friend that gets it might decide to promote it to their list of 100,000. 7. Failing to send out anything less than a blockbuster success While it would be nice to repeat viral marketing successes like Blair Witch, Hotmail, Purple Cow or ICQ those are rare occurrences. Just because your idea falls a bit short of phenomenal doesnt mean it isnt worth doing. Lets say you shoot for exponential viral results and only obtain a moderate success, it is still a success. The fact you got free visitors to come to your site is great. I love Michael Jordans quote when he attempted to go into baseball after his wildly successful basketball career. I can accept failure, but I cant accept not trying. Even if you think it wont blow away Blair Witchs success, try it anyway. 8. Focusing on a single viral piece rather than a viral process One thing Ive noticed in my business career is that we tend to adopt the John Wayne syndrome, go big or go home. We give it ONE try and if it fails we go home. I dont know of successful business people or successful marketing campaigns that take that approach. Instead of giving it this one shot and then not doing anything after that, create a process for creating, promoting, testing and measuring continual viral marketing efforts. 9. Failing to test and track the results To be successful you need to experiment with different titles for the article or e-book; test different ethical bribes; try different promotional methods; approach different list owners. Find all of the elements that can be tested in your project, test various combinations and measure the results. 10. Not recognizing it is different from word-of-mouth marketing I fell in love with word-of-mouth marketing early in my consulting career. After 10 years of consulting I analyzed every project Id worked on, every client Id worked for and wrote down the source. To my shock, 95% of all of them came from word-of-mouth. That is 1 out of every 50 people.....and some will be people you know. One out of every 10 Veterans is infected, 62% of Vietnam Vets have it. Three people with Hep C die every day, two of them are Veterans. Hepatitis C is considered an epidemic and is now killing more people than Aids/HIV...30,000 a year and it's going to get much worse. The number of adults seeking liver transplants for hepatitis C infection will skyrocket in the next 20 years. An estimated 10,000 to 30,000 Americans die from this disease each year. Deaths are estimated to increase because of the increasing risk of infection, and the resulting cirrhosis, portal hypertension, thrombocytopenia, bleeding from varices, and liver cancer. Five years ago, 20% of hepatitis C patients were candidates for liver transplantation and today the number has increased to about 50%. According to the Center for Disease Control (CDC), by the year 2008, the cases of decompensation will increase 279%, liver-related deaths 223% and the need for liver transplantation 528%. Considering that we don't have enough organs now and people die on transplant lists, far too many of those precious lives will be lost. For those fortunate enough to find a donor, the process costs roughly $300,000 during the first 3 months, and can be painful and incapacitating. To stabilize the vaccine, scientists used serum from Australian Aboregenese, hoping they were immune to endemic illnesses and that immunity would then be passed to our troops. Years later, it was discovered that 50% of the Aboregenese had Hepatitis B and C. A study done by the Veteran's Administration later PROVED that over 320,000 of our troops were infected. Thousands of them fell ill with hepatitis and hospitalized or quarantined in their barracks. When they came back home, they were encouraged to donate blood. A monster, with the power to mutate, had just been unleashed. Hepatitis C is transmitted through blood only. That means blood transfusions with contaminated blood before 1992 (because blood was not screened), tatoos, body piercing, needle sticks, IV drugs with contaminated needles, manicures that made you bleed (instruments are not sterilized), sharing razors, toothbrushes, anything that could pass infected blood to your blood. Even doing IV drugs once could have given you the virus or sharing straws with someone that had nasal sores or bleeding. A mutating virus for which there is no vaccine. It has many strains and substrains. By the time they figure something about it, it's already mutated into something stronger. 70-75% of people have genotype 1, the strain most difficult to treat. 95% of Veterans who have Hep C have genotype 1. The success rate with traditional modern medicine treatment is only about 50% and treatment is a whole year and side effects from the medications are cruel. For Veterans, success rate is only 19%....and sadly, even that treatment is approved for only 11.8% of them. 		<description><![CDATA[By Dan Kozarchuk The Settlers of Catan has been the flagship for German Style Designer Games for many reasons, some of the main ones being its elegant simplicity and its depth of strategy. Your choice of strategies will influence your initial setup and overall game play. The separation of strategies that are outlined in this series is a bit artificial, but it is useful to understand the concepts behind them. In practice, players will use a combination of these strategies during gameplay. This article, the fourth in this series, will discuss the Monopoly and Cartel Strategies. The Monopoly and Cartel Strategies are strategies to gain either exclusive control (monopoly) or shared control (cartel) of a particular resource, usually ore or brick as they have the fewest number of hexes in the basic game (three, versus four of all the others). First, the Monopoly variant, to gain more or less exclusive control. It is usually attempted by trying to control all of the good hexes (usually just one) of a resource by yourself. It seldom works. The major problem with this strategy is that the robber almost always sits on the monopolized hex. As you are the only person on that particular hex, the robber will stay there until YOU get it off (or a seven is rolled), unlike shared hexes. Also unlike shared hexes, every player EXCEPT YOU considers that hex to be fair robber placement territory, especially since they want a chance to grab that monopolized resource from your hand. A potentially better way to try the monopoly strategy is to let other players surround the best hex of that resource, and to go for the two less marginal ones (in the case of ore and brick). Then try to place the robber on the good hex throughout the game. This has the advantage of being able to place your initial settlements away from the rest of the crowd. You will need a lot of knights, to get the robber off of you, and onto the best hex. This would be good combined with the Card Builder strategy (to get the knights), especially if you are trying to monopolize ore or wheat. If someone in your group has the nerve to try a monopoly, it will become apparent very soon, probably in the initial setup. You can use this to your advantage by remembering that ports have just become more valuable real estate, and by using the monopoly player as a lightning rod for other players aggression instead of you (and drawing people's attention off of your own designs.) The Cartel variant. Basically, this is a strategy to share control of a particular resource in order to reduce the problem of the robber in a monopoly, but to make sure that you are the dominant player in that cartel. In this variant it is only necessary to control most of the resource. For example, if you control two out of the three settlement locations on a good hex of a rare resource. The other player will work just as hard to keep the robber away, but will only collect half as much. This is most common on a good ore hex. Another way this can be done is by having majority access to several hexes for a commodity for which you have a port. The other players can't keep the robber on all of them, and will probably just keep it on your prime hex. Sheep and wheat are most typical of this kind of cartel, because they are not the commodities that people usually target during initial placement. Note that this is very similar to the Common Resource Strategy. Similar to the Monopoly variant, you will need a lot of knights to keep the robber away, and preferably on your opponents most productive hexes, or on a resource your opponent has a port for (so they can't trade easily for your resource). In this way, if you find yourself in total control you can make really good trades. Depending on your group, you can make 3:1 trades if people are desperate, and even turn these down if you are ahead, and force them to make 4:1 bank trades.
